Каждая опубликованная выдержка была прочитана и классифицирована по резолютивной части самого решения — по формулировке, начинающейся словами «По этим основаниям Комиссия», — а не по краткому изложению или ключевым словам. Если Комиссия признавала оспариваемые данные не соответствующими правилам Интерпола, данные удалялись. Что именно рассматривает Комиссия

Комиссия не пересматривает уголовное дело заново. Она не устанавливает виновность, не оценивает доказательства так, как это делает суд, и не решает, должна ли состояться экстрадиция. Её вопрос уже: вправе ли Интерпол на законных основаниях продолжать обработку этих данных?

На практике повторяющиеся основания делятся на пять групп, вокруг которых и построена база данных ниже:

Большинство решений затрагивают сразу несколько оснований, поэтому сумма по пяти группам превышает общее число решений.

Каждая запись содержит номер решения, тип оспариваемых данных, основания, которые рассмотрела Комиссия, исход и резолютивную формулировку решения. Полная анонимизированная выдержка приложена в формате PDF именно так, как её опубликовал Интерпол.     A Red Notice exists to pursue extradition, not to bring a person in to assist an investigation: where the requesting state was still working through a mutual legal assistance treaty, the Commission found the case had not reached the stage of charge or extradition that Article 83(2)(b) of the RPD requires, and the data were deleted.

    Lack of action for extradition · Political character

    Proximity to an ousted head of state and the timing of charges after a change of regime were not enough on their own. The Commission also held that issuing a valid Red Notice does not in itself infringe the freedom-of-movement right in Article 13 of the Universal Declaration, which is subject to lawful and proportionate limits.

    Private matter · Unfunded cheques

    Signing a cheque that could not be honoured, without any clear explanation of how that amounted to a criminal offence rather than a breach of contract, does not justify a Red Notice: the minimum criteria of Article 83(1)(a)(i) of the RPD were not met.

    Where several national courts, international bodies and arbitral tribunals had already found the wider prosecution politically motivated, the political elements predominated over the ordinary-crime elements. The Commission treated political context and the fairness of the proceedings as inseparable and deleted the data without reaching the remaining arguments.

    Reexamination

    On an application for revision, a refusal of extradition by another country was not a new fact where both states were still negotiating and the procedure remained in progress; revision was refused because the conditions of Article 19 of the Operating Rules were not met.

    A favourable decision obtained by a co-accused cannot simply be transposed: deletion in the related case rested on elements specific to that applicant, and a general context already known to the Commission is not a new fact for the purposes of revision.

Как использовать этот каталог в реальном деле

Часто задаваемые вопросы о решениях CCF

Публикует ли CCF все свои решения?

Нет. Комиссия публикует только анонимизированные выдержки из решений, которые считает показательными, и не раскрывает персональные данные заявителей. Опубликовано шестьдесят пять выдержек за 2017, 2018, 2019 годы и период с 2023 года по настоящее время; за 2020, 2021 и 2022 годы выдержки не публиковались.

Являются ли решения CCF обязательным прецедентом?

Нет. Комиссия не является судом и не применяет доктрину прецедента, поэтому более раннее решение не связывает последующее. Тем не менее опубликованные выдержки имеют практическое значение, поскольку показывают, как Комиссия рассуждала по повторяющимся основаниям и какие доказательства считала достаточными.

Что именно вправе распорядиться Комиссия?

Она может признать, что данные, хранящиеся в файлах Интерпола, не соответствуют правилам Организации, — в этом случае данные удаляются. Она также может распорядиться об исправлении или обновлении файла при сохранении самого уведомления, а на время рассмотрения дела доступ к данным может быть временно заблокирован.

Почему в решениях не указана страна?

Перед публикацией Комиссия вымарывает страны, даты, имена и номера дел. Все такие купюры в этих документах сделаны самим Интерполом; мы ничего не удаляли. По этой же причине базу нельзя фильтровать по запрашивающей стране.

В чём разница между основаниями по статье 2 и статье 3?

Статья 3 Устава Интерпола запрещает Организации любое вмешательство в дела политического, военного, религиозного или расового характера и применяется, когда уголовное преследование считается политически мотивированным. Статья 2 обязывает Интерпол действовать в духе Всеобщей декларации прав человека и охватывает риск пыток или жестокого обращения, угрозу жизни и серьёзные медицинские основания.
