He Said the Case Sat Dormant for Fourteen Years — It Had Not

He said the case sat dormant for fourteen years before any notice was ever sought, proving nobody was really interested in pursuing him. He also produced a handwritten letter he said was from the complainant, withdrawing her accusation entirely. Neither survived contact with the file: the notice had existed for a decade already, and the letter proved almost nothing at all.

A promised import that never arrived

He was accused of collecting a substantial sum by promising to import several vehicles from abroad within a set number of weeks, presenting himself as connected to both a local travel company and an overseas motor dealer. The money was transferred; the vehicles were not delivered, and according to the requesting bureau he used the funds for himself instead.

The delay argument, undone by the record itself

His most confident argument was procedural: the underlying events dated back many years, and the actual request for an international notice had, he said, only been made recently — fourteen years of apparent inaction that he offered as proof the case held no real interest for international cooperation at all. The Commission checked the claim against its own records and found it simply false: the notice had in fact been issued roughly a decade earlier than he stated, with a later update in an unrelated year adding identifying details. An argument built entirely on a mistaken timeline collapses once the actual dates are checked.

A withdrawal letter that could not do the work asked of it

He also submitted a brief, handwritten note presented as coming from the person who had originally complained, stating that her claim had been resolved and asking for the case to be closed. The Commission examined it and found it wanting on its own terms: nothing established who had actually written it, whether it had genuinely been received by any authority, or how it had come into his possession in the first place. Beyond that evidentiary gap, the Commission made a broader point worth remembering — even a fully authenticated withdrawal by a complainant does not automatically end a public prosecution, which can proceed on the strength of the investigation already carried out, independent of the original complainant’s continued participation.

The private-dispute argument, and the rule behind why it failed

He framed the whole matter as a commercial disagreement over an undelivered vehicle import, which should have excluded it from INTERPOL’s channels entirely as a private dispute. The Commission stated the underlying principle clearly: the private-dispute exclusion does not automatically remove classic offences like fraud simply because they arose between private individuals. What matters is the overall criminal character of the conduct, assessed on all the available information. Here, the file described specific deception — a false identity, a false connection to two named businesses, a fabricated timeline for delivery — which took the matter well beyond a simple failure to perform a contract.

What this case shows

This account is drawn from one of our own decisions. The countries, the businesses, the vehicles, the amounts and the dates are withheld, and the allegation is described only by category.

If you believe a notice has gone unused for many years, verify the actual issuance and update dates before relying on that argument — the real history is often different from what the file first suggests. Send us what you know about your notice’s timeline and we will check it against the record.

Delay claims and withdrawn complaints

If years have passed since the underlying events, does that show the case has no real interest for international cooperation?

Only if the actual timeline supports it. Claims about how long a notice has existed should be checked against its real issuance and update history, which can differ significantly from an applicant’s assumption.

Can a letter from the original complainant withdrawing their accusation end the case?

Not on its own, and particularly not if its authorship and delivery cannot be verified. Even a genuine withdrawal does not automatically end a prosecution that can proceed on the investigation already gathered.

Is every dispute between two private individuals excluded from being treated as fraud?

No. Where the file describes specific deception — a false identity or a fabricated business connection, for example — the matter can be treated as criminal despite arising from a private transaction.
