DEFENDING YOUR CASE FROM START TO FINISH
Representation at arrest and bond hearing stages:
"Waiting to see what the prosecutor files" before contacting an attorney may not be the best strategy for you. From the moment of your arrest,
the police have begun to build a case against you. The prosecutors office will speak to police officers and to their witnesses prior to making
a decision about which charges to file against you. If you have a defense, defense witnesses, or evidence in your favor, it does you no good
unless the prosecutor knows about it. Our firm acts on critical defense information immediately, ensuring that the prosecutor has all the
information necessary to avoid filing unfair or unsustainable charges.
Early Investigative Defense Work
Some cases require immediate investigative work. Witnesses memories can fade over time or they may move; video surveillance may be erased if not
preserved; and physical evidence such as signs, skid marks, or injuries proving self-defense can disappear if not documented immediately. By
working to quickly preserve and document evidence, we can increase your chances that invalid charges will be dropped and over-charged cases can be
reduced as soon as possible.
Bond Issues
The law Offices of Michelle A. Estlund, P.A. handles every type of bond issue, including Nebbia hearings (to verify the source of funds and collateral
used for bond); motions for bond reduction or modification; and Arthur hearings (hearings to request bond for cases punishable by life imprisonment).
Pre-trial and Trial Representation
If the State files charges against a client, many people refuse the States offer of a plea agreement in favor of proceeding with the discovery
process, in order to more fully examine the States evidence and testimony against them. In these cases, our firm takes statements of all witnesses,
tests evidence, hires polygraph examiners, or files motions necessary to show the weaknesses in the case against our clients. When a trial is required,
our clients receive aggressive, skilled representation with a goal of obtaining a verdict of "Not Guilty."
Representation After Your Case is Closed
Your legal needs may not end when your case is dropped, when you accept a plea, or after you go to trial. For those clients needing assistance after
the case is closed, we offer representation for the following matters:
Sealing and expunging records |
|
Motions for return of property |
Unsealing for immigration matters |
|
Probation violation hearings |
Motions to vacate pleas |
|
Motions to travel |
